Terms of Use

These terms are an agreement between you and Bold Biscuit ("we") covering the EQBase app for macOS. By downloading or using EQBase you agree to them. They are also EQBase's end-user license agreement (EULA); the "License agreement" link in the app points here. We've kept them as readable as we can.
The free tier
EQBase's free features cost nothing to use, for personal and commercial purposes alike, with no trial period and no time limit. We won't start charging you for a free feature you already rely on: if a feature ever changes tiers, that applies to future versions, and the version you have installed keeps working as it is. Like everything else in EQBase, features evolve over time as described in "Updates, compatibility & the long term" below.
Pro licenses
Buying EQBase Pro grants you a personal, non-exclusive, non-transferable license to use the Pro features on the number of Macs your plan includes. That is a license to use the software, not a sale of the software itself. Current prices are shown on the pricing page and at checkout; the price at checkout is the one that applies to your purchase, and prices for new purchases may change at any time.

Subscriptions renew automatically until you cancel. Each period is billed at the then-current price for your plan; if that price ever changes for existing subscribers, we'll notify you before it takes effect, with time to cancel first. Cancelling stops future charges, and Pro stays active until the end of the period you've paid for. You can manage or cancel a subscription from the app's License window or through the Lemon Squeezy customer portal linked in your receipt, and move activations between Macs from the License window.
The app revalidates your license in the background and tolerates being offline for a grace period, so Pro doesn't depend on a constant connection. If a license lapses, is refunded, or a subscription ends, Pro features switch off but your settings and presets are kept, so everything lights back up if you return.
Purchases are processed by Lemon Squeezy as the merchant of record; the sale itself is a transaction between you and Lemon Squeezy under their terms of sale. Every purchase has a 14-day refund policy.
What "lifetime" means
A Pro Lifetime license is a one-time purchase that never expires and never bills again. It covers every Pro feature that exists at the time of purchase, together with the updates to EQBase (fixes, compatibility work, and improvements to those features) that we release while EQBase remains in active development. It is a perpetual license to the app, not a subscription to everything we may ever make and not a promise of perpetual services. Specifically:
- "Lifetime" refers to the lifetime of the product, meaning for as long as Bold Biscuit offers and supports EQBase. It is not the lifetime of a person, a Mac, or macOS, and not a guarantee that the app, its updates, or its supporting services will exist forever.
- We may release future major versions, successor products, or substantial new features as separate purchases or paid upgrades, which a lifetime license does not automatically include; where we do, we may offer existing customers upgrade pricing.
- Compatibility with future macOS versions and future Mac hardware depends in part on Apple and cannot be guaranteed. The versions of EQBase released while your license was current keep working on the systems they were built for.
- If we ever permanently discontinue EQBase or its license-activation service, we will make reasonable efforts to release a final version that lets existing lifetime licenses keep working without online activation.
Updates, compatibility & the long term
We release updates (new features, fixes, and compatibility work) at our discretion. We don't promise that any particular future feature will ship, any particular update cadence, or that EQBase will remain compatible with every future version of macOS or every Mac model; operating-system changes outside our control can affect what's possible. We may change, suspend, or discontinue features, either tier, or the product itself. None of this reaches back into the copy of EQBase you already have installed, and the refund policy applies as usual to recent purchases.
What the app installs
To process system audio, EQBase asks macOS for permission to record this computer's audio; a normal setup installs nothing else. Two optional features, Audiophile mode and Pro audio routing, use a virtual audio driver, and EQBase installs it along with a small helper that performs the privileged install only if you turn one of them on; macOS asks for your approval first. Updates are delivered through the app's built-in updater. If you stop using EQBase, everything it installed can be removed; if you'd like help, Support will walk you through it.
Sound & hearing
EQBase can increase loudness through volume boost, EQ gain, and effects, and a strong boost can drive headphones and speakers harder than their makers intended. Set levels carefully, especially with headphones: listening at high volume can damage your hearing, and extreme settings can damage audio equipment. You are responsible for the listening levels and settings you choose. EQBase's limiter is a safety aid, not a guarantee.
Third-party software
EQBase ships with open-source software, including the AutoEQ headphone-correction dataset (MIT, © Jaakko Pasanen), the bs2b crossfeed algorithm, and the Sparkle update framework; their licenses and attributions are shown in the app and are unaffected by these terms. Headphone presets are community measurements provided as-is, with no promise that they suit your specific unit or taste. Audio Unit plugins you install and host through EQBase are third-party software under their own terms: we don't control them and aren't responsible for them, though EQBase is built to isolate a misbehaving plugin.
License rules
Keep it fair: don't redistribute the app or license keys, share, sell, or rent licenses, work around the license system or feature gating, or use EQBase in violation of the law. Don't reverse engineer or modify the app except to the extent the law expressly permits it despite this term. License keys are sold only by us through Lemon Squeezy; keys obtained anywhere else may be invalid and may stop working.
Termination
You can stop using EQBase at any time, and uninstalling removes everything it installed. We may suspend or deactivate a license if these terms are seriously breached (for example redistributed, resold, or fraudulently obtained keys, or a charged-back purchase), if the purchase is refunded, or if the law requires it. The sections of these terms that by their nature should survive (including "License rules", "Sound & hearing", and "No warranty & limitation of liability") survive termination.
Online services
License activation, update delivery, and crash reporting are online services that run on third-party infrastructure. We aim to keep them available, but they may be interrupted for maintenance or reasons outside our control; the app is built to tolerate this: Pro works offline for a grace period, and a lifetime license works offline indefinitely. Temporary unavailability of these services is not a breach of these terms.
No warranty & limitation of liability
EQBase is provided "as is" and "as available," without warranty of any kind, express, implied, or statutory (including implied warranties of merchantability, fitness for a particular purpose, and non-infringement), and we don't warrant that it will be uninterrupted, error-free, or compatible with every system, device, plugin, or workflow. We work hard to keep EQBase stable and transparent, but audio software sits on a system layer we don't control.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or connected to EQBase (including consequences of the listening levels or settings you choose), and our total liability for all claims connected to EQBase is limited to the amount you paid us for it in the twelve months before the claim arose, or USD 10 if you haven't paid us anything. Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, or rights you have under mandatory consumer law.
Changes
We may update these terms as EQBase evolves. If a change is material, we'll note it here with a new date and, where it meaningfully affects paid licenses, point it out in the app or by email. Continued use after a change means you accept the new terms; if you don't agree, stop using the app and, for subscriptions, cancel.
Governing law & disputes
These terms are governed by the laws of the Republic of Türkiye, and disputes are subject to the courts and enforcement offices of Istanbul, except that if you are a consumer, you keep every protection granted by the mandatory laws of the country where you live and may be entitled to bring proceedings there. Before any formal step, please just write to us; nearly everything can be sorted out by email.
General
If part of these terms turns out to be unenforceable, the rest stays in force. These terms, together with the refund policy and privacy policy, are the entire agreement between us about EQBase; marketing copy is a description of the product, not an extension of these commitments. You may not transfer your license or this agreement except where the law provides otherwise; we may assign this agreement as part of a merger, acquisition, or sale of EQBase, in which case your license carries over to the new owner. Our not enforcing a term is not a waiver of it. You must be legally able to enter into a contract to purchase Pro.
